Kristin S. Godfrey, Esq.

Lucas T. Ritchie, Esq.

Thomas P. McMahon, Esq.

In this transitional time in banking, many bank officers and executive management find themselves entertaining or pursuing a change in employment.  During this series, the basic elements of, and distinctions among, restrictive covenants such as non-competition, non-solicitation, non-hire and confidentiality, will be explained and explored, as well as the associated anti-trust implications of such agreements between or among financial institutions.  Enforcement of restrictive covenants, specifically in the areas of scope and duration, will also be addressed, as well as the relevance of social media to such restrictive covenants.  Techniques for negotiating restrictive covenants will be presented.  This discussion details important information that is of significance for all levels of bank management.
