How to deal with troubled loans and avoid lender liability
As the Office of the Comptroller of the Currency recently emphasized in its Spring Semiannual Risk Perspective, released on June 29, 2020, “[t]he rapid decline in economic conditions will broadly affect bank earnings, credit quality, operations, and capital.” The OCC noted that operational risk is elevated as banks implement new processes and procedures to work in a COVID-19 world and to deal with increasing loan losses. On June 29th at 10 a.m., the Colorado Bankers Association is hosting a webinar presented by our friends at the Faegre Drinker law firm. This program is designed for front-line bank employees who are working to help customers in a bind during these challenging times, while protecting the bank. The program will cover issues related to default, work-outs, and preparing for bankruptcies, with an emphasis on spotting and avoiding lender liability issues.
